Cherwell District Council Self Build Register Policy

The Self and Custom house building register holds details of persons/associations who want to acquire serviced plots of land in the district for self-build and custom house building.

In October 2016, changes were made to the legislation that strengthened our role in making available plots of land that can be used for self-build and custom house building. The regulations also provide us with the option to include a local connection test and a criterion to demonstrate that an individual has the financial resources to purchase land for self/custom build.

As from 1st April 2017 the register will be divided into two parts.

  • People who meet the local connection test, the financial resources test and the basic eligibility
  • People without a local connection but meet the basic eligibility

In order to register you must meet the basic eligibility:

  • be aged 18 or over
  • A British citizen, a national of a EEA State other than the UK, or a national of Switzerland
  • Seeking (either alone or with others) to acquire a serviced plot of land in Cherwell District to build a house to occupy as your sole or main residence

Part 1 – people/associations with a local connection

To be eligible for Part 1 of the register, you will need to:

  • Meet the basic eligibility; and
  • Meet the Local connection test, and
  • Have lived in the Council district for a period of at least 12 months immediately prior to the date of your application to join the register; or
  • Have previously lived in the Council district continuously for a period of at least 3 years out of the past 5 years immediately prior to the date of your application to join the register; or
  • Have permanent employment within the Council district; or
  • Have immediate family members (spouse / partner, parents, step parents, adult (aged 18 years and over) children or step children, or siblings and step siblings) who have lived in the Council district continuously for at least 5 years immediately prior to the date of your application to join the register.
  • Meet the financial resources test

Applicants will need to certify that they have sufficient resources to purchase land by:

  • Identifying in approximate terms of amount of land that would be needed to accommodate the size of property they are looking for in the area they are interested in
  • Indicating the approximate cost of such a site and evidencing this by way of examples of recent comparable sales or confirmation from a registered valuer
  • Outlining how they intend to fund the project.

Those who register and fulfil each of the above eligibility criteria will be included in Part 1 of the register.

The only exception to the above will be members of the armed forces. Anyone who is in the service of the regular armed forces of the Crown is deemed to satisfy the connection test, and anyone who has previously served in the armed forces will be deemed to satisfy the connection test for a period of ten years after leaving service.

Part 2 – people/associations without a local connection or sufficient financial resource to purchase land

To be eligible for Part 2 of the register, you will need to have met the basic eligibility.

What is the difference between Part 1 and Part 2 of the register?

Section 2A of the Self-Build and Custom Housebuilding Act 2015 imposes a legal duty on us to grant sufficient development permissions to meet the demand for self- build and custom house building; this duty only applies to entries on Part 1 of the register.
